Alternative Dispute Resolution Practice
Mr. Day is an alternative dispute resolution professional. MEDIATION:
"'Mediation' means a process in which a mediator facilitates communication and negotiation between parties to assist them in reaching a voluntary agreement regarding their dispute." Utah Code Section 78B-10-102(2). Accordingly, as a mediator, Mr. Day is a neutral third party trained in the law and the art of peacemaking who can help disputing parties resolve their disputes, but he cannot order a resolution of your dispute. Through an effective mediation process most disputes can be resolved quickly and without all the heartache and expense of litigation. |
ARBITRATION:
"'Arbitrator' means an individual appointed to render an award, alone or with others, in a controversy that is subject to an agreement to arbitrate." Utah Code Section 78B-10-102(2). Unlike mediation, arbitration results in a compelled resolution of your dispute. As an arbitrator, Mr. Day will hear your dispute much like a judge would hear your dispute in court, but with much less formality, on an expedited schedule in a private setting. When disputing parties cannot resolve their disputes by agreement through mediation or otherwise, arbitration offers a quick and inexpensive path to a final resolution. |
